Birds Terms of Service

Effective date: July 15, 2026

Birds is operated by Base Social, Inc., a Delaware corporation headquartered in Miami, Florida ("we", "us"). By creating a Birds account you agree to these terms. If you do not agree, do not use Birds.


SMS / text message terms

This section covers the Birds one-time passcode program, and is the authoritative description of our text messaging.


1. Who can use Birds

You must be 18 or older to create a Birds account. Birds is a dating service intended for adults. If we learn that an account belongs to someone under 18, we will terminate it and delete the data.

2. One account per person

Birds gives each person a single bird, and that only works if each person has one account. Do not create multiple accounts, share your account, or impersonate anyone else.

3. How you must behave

You are responsible for what you send through Birds. You may not use Birds to harass, threaten, defraud, or harm anyone; to send sexual content to people who have not asked for it; to solicit money; to advertise; or to break the law.

We have zero tolerance for abusive content or behavior. Every introduction and conversation in Birds can be reported, and you can block any user from your Finds and conversations at any time. We review reports and remove accounts that violate these terms — usually without warning.

4. Your content

You keep ownership of your photos and messages. You give us a limited license to store, display, and transmit them only to operate Birds — to show your photos to people your bird introduces you to, deliver your messages, and run the features you use. We do not use your content for advertising, we do not sell it, and this license ends when you delete the content or your account.

5. Your bird

Your bird is a character in software. Its opinions, secrets, and introductions are generated by our systems, not by a real person, and are not professional advice of any kind. Purchases inside Birds (such as a second bird) are for digital items only and confer no ownership or real-world value.

6. Ending things

You may delete your account at any time from within the app; deletion is permanent after a 30-day grace period. We may suspend or terminate an account that violates these terms, is used for fraud, or exposes us or others to legal risk.

7. No warranty; limitation of liability

Birds is provided "as is". We do not guarantee that your bird will find anyone, that introductions will lead to relationships, or that the service will be uninterrupted. We are not responsible for the conduct of other users, online or in person. Meet people safely: meet in public, tell a friend, trust your instincts.

To the fullest extent permitted by law, Base Social, Inc.'s total liability arising out of your use of Birds is limited to the greater of the amount you paid us in the twelve months before the claim, or $100.


8. Disputes, arbitration, and governing law

Please read this section carefully — it affects your legal rights, including your right to bring a lawsuit in court and to participate in a class action.

8.1 Talk to us first

Most problems can be solved without lawyers. Before starting arbitration or filing any claim, you agree to email support@getbirds.app with a short description of the problem and what you would like us to do. We agree to do the same for any claim we have against you. Both sides will try in good faith to resolve it for 60 days before going further.

8.2 Binding individual arbitration

If we cannot resolve a dispute informally, you and Base Social, Inc. agree that any dispute arising out of or relating to Birds or these terms will be resolved by binding individual arbitration, not in court, and not before a jury. Arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and judgment on the award may be entered in any court with jurisdiction.

The arbitration will be seated in Miami-Dade County, Florida. You may choose instead to have your arbitration conducted by videoconference or on written submissions only, and if you do, you will not have to travel. Under the AAA Consumer Rules, we pay the bulk of arbitration fees; if the AAA requires you to pay a filing fee and paying it would be a hardship, contact us and we will pay it for you.

8.3 Class action waiver

You and we agree to bring claims only individually, and not as a plaintiff or class member in any class, collective, consolidated, or representative action. The arbitrator may award relief only to the individual party seeking it, and only to the extent needed to resolve that party's claim. If this paragraph is found unenforceable as to a particular claim, that claim — and only that claim — will be decided in court under Section 8.6, and the rest of this Section 8 still applies.

8.4 Coordinated filings

If 25 or more similar arbitration demands are filed against us by or with the help of the same lawyers or coordinated group, the AAA's rules for multiple case filings will apply and the cases will be batched — resolved in staged groups of up to 50, with a single arbitrator per batch and one outcome per batch informing the rest — to keep the process fair and workable for everyone. Statutes of limitation are tolled for demands awaiting a batch.

8.5 Small claims

Either of us may bring an individual claim in small claims court in the county where you live or in Miami-Dade County, Florida, instead of arbitration, as long as the claim stays in that court and stays individual.

8.6 Your right to opt out of arbitration

You can decline arbitration. Email legal@getbirds.app within 30 days of the date you first accept these terms, with your name, the phone number or email on your account, and a statement that you opt out of arbitration. That is all it takes. Opting out will not affect your account, and no other part of these terms changes. If you opt out, disputes are resolved in court under Section 8.7.

8.7 Governing law and venue

These terms and any dispute between us are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, except that the Federal Arbitration Act governs Section 8.2. For any dispute not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida, and each of us waives any objection to that venue and waives the right to a jury trial.

8.8 Rights you keep regardless

Nothing in this section takes away rights that cannot be waived under the consumer protection laws of the place you live. If you live somewhere that does not permit any part of this section to be enforced against you, that part does not apply to you.

8.9 Changes to this section

If we change Section 8 in the future, the change will not apply to any dispute we already knew about, and you may reject the change by emailing legal@getbirds.app within 30 days of it taking effect.


9. Changes

We may update these terms. If we make a material change we will notify you in the app before it takes effect. Continuing to use Birds after that means you accept the updated terms.
